Ow!
My ears are popping like I am 50 thousand feet up in the air. I went swimming after work last night. My pool is not too long, but I managed a couple of laps. I am so out of shape. I would of done more laps though, had I not got suckered in by this woman to watch her two kids while she went to get laundry. I am no lifeguard, I should of said no. One of the boys scraped his toes and I was sure I had a law suit on my hands, but she was ok with it, though she implied I stole one of the boys toys. Whatever.
Stuck to the diet last night–had tofu stirfry. I made some chicken for tonight. You know, I really hate chicken. I need to quit buying it. I mean, I never CRAVE chicken. Do you? I mean sure hot wings, and some KFC ain’t shabby. My mother made decent roast chicken, but it just is kind of ‘eh.’ I could live without chickens–well not their eggs.

It must begin with dispelling the myth that the Nixon administration settled in 1972 for terms that had been available in 1969 and therefore prolonged the war needlessly. Whether the agreement, officially signed in January 1973, could have preserved an independent South Vietnam and avoided the carnage following the fall of Indochina will never be known. American dissociation triggered a massive North Vietnamese invasion, in blatant violation of existing agreements, to which the nations that had endorsed these agreements turned their backs.
State leaders did reach a compromise. Politicians are good about those things (sometimes). The Lexington Barbecue Festival will be the “official” Food Festival of North Carolina. See -no mention of barbecue there. But, you head over to the October festival, and I can tell you what you’ll be eating. Yep. Barbecue - Lexington style (vinegar). Yum!

And while I was grilling . . .

While I was busy thinking about outdoor cooking, my mom was hard at work making Raggedy Andy and Ann for a family friend.

Mom has made rag dolls as far back as I can remember. My set is in lavendar.

Oh, am I? Gee. The truth hurts, doesn’t it? Hey, I’m a conservative and conservatism deals in reality, not Nirvana.

We are importing a ready-made underclass, which will become wards of the government as soon as they cross into US territory. Being a ward of the government means two things: You and I will have to support them and take care of their needs, and it also means… the liberal government will guarantee the wards pay them back for all this national largesse by keeping them in office with their votes!
I made one Raggedy Ann, but it took FOREVER. I don’t have that much patience. So, I stick with grilling and smoking. It does take time to make great food, but it’s not as tedious as trying to get poly-fill in the arms of little doll babies.
I’m constantly amazed at Democrats who routinely accuse the President of “not learning from past mistakes” on any number of issues, but in particular, regarding wars, while they in turn work tirelessly to repeat those same mistakes in order to …. appease their defeatist moonbat base (that they ended up backing down on the war supplemental doesn’t negate that point) and even more bizarrely, they claim that it’s done in the name of “supporting the troops.”

Kissinger makes a lot of sense, so make sure to read the whole thing.

Are mediators hindering a civil right to counsel?It behooves all of us who serve in a profession to pay attention to the way our work is perceived or our profession characterized. In particular we should heed the criticisms, whether just or not, that are raised about our work, so we can learn from or counter them.

Mediators may then wish to know how we are viewed by one scholar in a movement afoot here in the U.S. This movement would expand the right to counsel in criminal cases to civil litigation. It comes in response to a challenge that many in the legal community recognize but do not always agree how best to address: the rising number of pro se litigants in civil and family court cases.

Oil Companies Encouraging Employees to Bike to Work

In an odd twist, some Houston oil companies are making a push to provide incentives for employees to commute using bicycles rather than gas guzzling automobiles. The incentives include providing lockers, showers, and safe places to keep their bikes.

What a concept… pay your employees for not supporting your product. Now we just need electric companies to just give incentives for it’s employees to use candles, water companies to promote milk, and television companies to run book drives.

I think I probably spent close to $1000 at MEC the past month. $400 at the Gear Swap, ~$330 few days ago for my new & shiny sleeping bag, then today ~$65 for a climbing helmet and a climbing sling.

Ok apparently I can’t do math. 400 + 330 + 65 != 1000.

I need to stop spending money at MEC for a while…

After reducing poverty, balancing the budget and eradicating terrorism, the House of Representatives today decided to ban the slaughter of horses.

The American Horse Slaughter Prevention Act, which still awaits approval by the Senate, passed on a 263-146 vote, setting the stage for the possible elimination of an industry that Rep. Edward Whitfield (R-Ky.) called “a grossly inhumane business.”

“This whole slaughtering process is an illicit, concealed, inhumane process as it relates to horses,” said Whitfield, one of the bill’s co-sponsors and its most vocal champion on the House floor.

The three horse slaughterhouses in the United States—one in DeKalb, Ill., and two in the Dallas-Ft. Worth area—are foreign-owned and export most of their meat to Europe and Japan. About 90,000 horses were slaughtered in the United States last year.

Several months ago someone tried to post one of those unwelcome comments that all bloggers receive from time to time. With plenty of full capitalization for emphasis, and with attacks on my character and personal habits thrown in for good measure, the writer accused me, among other things, of undermining the rule of law simply because I happen to be a mediator. Since I allow attacks on ideas only not on people on this blog, I hit “delete”.

I have remained haunted however by the concern this person raised. Were they right–does ADR weaken the rule of law?

I have written critically before of ADR’s two-edged nature and encouraged my fellow ADR practitioners to consider with care their responsibility to the public and to our institutions of justice.

Of course we as a profession should ask ourselves these kind of questions. Does ADR undermine the rule of law? If justice is the end, is ADR the best means?

-Went to Lighthouse Park in West Vancouver for some climbing last Thurs evening with Ralph, Evan, and Peter. It was my first time there. Gorgeous views and awesome routes. Will have to go back there again for sure!

-Matt, Peter, Evan, and I went down to Seattle the past weekend. The trip was originally proposed by Colin back in March but it kept getting postponed. It was too bad that not everyone could go (Colin, Kung, Feaver).

We drove down Sat morning from Vancouver and checked out the Boeing factory first. Coming from an engineering background I was quite amazed by the ingenuity behind airline industry. We then went to REI to check out some outdoor gear and was annoyed by the pushy REI employees trying to sell us REI memberships. It’s certainly different than how things are run at MEC here in Canada…

Surprisingly Sat night wasn’t too much of a gong show. Having eaten lunch at Jack In the Box around 2 pm we decided that we’d start drinking before having dinner.

Larry Coker

Did Coker Deserve Getting The Hook?

Larry Coker, who was of last week; the coach for the University of Miami Hurricanes and was there from 2001 – 2006, put up a good record despite All of the things that had happen during the course of the season.

Some would say 6-5 is not that bad of a record, giving what the hurricanes had gone threw. And rightfully so they are right, but it’s the University of Miami and even with all the problems that is unacceptable with the school.

But in my mind the problems started, way back during that embarrassing lost against the tigers of LSU (Louisiana State University).in the peach bowl 40 to 3 because after that game, Larry Coker made assistance coaching changes mainly because if he had not he would have been fired.

So Coker knew coming into this season, that it was a make or break year for his tenure as their football coach at Miami. And as it turn out the season was one of the worst in the past decade in the school football program history.

Did he know there where going to be a brawl with FIU (Florida International University) no, but has a coach you have to have control of your football team.

Even if FIU started it from the get go and as a result he got fired, for not only for the brawl but because he lost total control of his football team during the course of the season.

NHL Playoff Hockey

This is Just In: NHL Playoff Hockey is far better then the NBA Playoffs.
Everyone up to our north in Canada knows it and now I will tell you why playoff hockey is far better then the National Basketball Association (NBA) equivalent of postseason play, their are three reasons in my view; the first reason is the flow of the game, second is the prestige of the Stanley Cup and the third is the apparition for athletic talent.
The flow of a National Hockey league (NHL) playoff game and the athletic ability of the players are two of the best reasons out of the three in my view; the flow of the game is so intense, that when your team shoots and makes a goal you feel like you will be having a heart attack in a mater of moments and when the other team shoots and gets the goal, you feel like you have just been hit by a semi truck.
The athletic ability, of the players in the NHL are amazing, whether it be in a playoff game or not the players athletic ability and toughness and their desire are really true sights of athletic ability, imagine being slam into the boards and with in the matter of seconds you get up and go towards the player who has the puck and then play defense, remember you are doing all of this on ice skates.
The prestige of the Stanley Cup is well known around the sporting world but it has even a meaning in Canada then in other country in the world, as in today NHL game it is extremely rare that a team from Canada wins lord Stanley, but that could end this year as Canada has only one team left in this year quest for the cup, but unlike the last two years when a Canadian team has lost a Stanley cup finals series (Calgary to Tampa in 04 and Edmonton To Carolina 06) this year team the Ottawa Senators could actually win it but they first have to take care of the Buffalo Sabers in the eastern conference finals.
But the most important thing is how much an entrainment value do you get from it, to be able to sit down and actually watch these two professional leagues playoff games on television, but for me, i get more entertainment value and fun by watching the NHL playoffs and so does the country of Canada.
